1.Acceptance of Terms

By accessing and using the William Marrow website and services ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

2.About the Service

William Marrow is an online question bank and study resource designed to assist medical professionals in preparing for postgraduate medical examinations. The Service provides practice questions, explanations, progress tracking, and related educational tools. William Marrow is operated from Brisbane, Queensland, Australia.

3.User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

• You must be at least 18 years of age to use the Service.
• You must not share your account credentials with any other person.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4.Subscriptions and Payments

Access to the question bank requires a paid subscription or gifted access granted by an administrator. By purchasing a subscription, you agree to the following:

• All payments are processed securely through Stripe. William Marrow does not store your credit card details.
• Subscription plans are available in 3-month, 6-month, and 12-month periods. Prices are displayed in Australian Dollars (AUD) and include GST where applicable.
• Subscriptions do not automatically renew. You will need to purchase a new subscription when your current period expires.
• Subscription fees are non-refundable except as required by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
• We reserve the right to change pricing for future subscription periods with reasonable notice.
• Gifted subscriptions awarded by administrators are subject to the same Terms as paid subscriptions.

5.Acceptable Use

You agree not to:

• Copy, reproduce, distribute, or publicly display any content from the Service without prior written consent.
• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to any part of the Service, other accounts, or computer systems.
• Use automated scripts, bots, or scrapers to access or extract content from the Service.
• Share question content, explanations, or any proprietary material from the Service with non-subscribers.

6.Intellectual Property

All content on the William Marrow website, including but not limited to questions, explanations, images, text, graphics, logos, and software, is the property of William Marrow and is protected by Australian and international copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

To the maximum extent permitted by law, William Marrow and its officers, employees, and agents:

• Are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Are not liable for any errors, inaccuracies, or omissions in the content, or for any clinical decisions made based on the content.
• Do not warrant that the Service will be uninterrupted, secure, or error-free.
• Limit total aggregate liability to the amount paid by you for the Service in the 12 months preceding any claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot be excluded by agreement.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10.Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law survive termination.

11.Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12.Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
